| المستخلص: | قد يستدعي التحقق من صحة الواقعة محل الإثبات البحث في مسائل لا يلم القاضي بها، كالمسائل الطبية أو الهندسية أو المحاسبية أو حوادث السير، لذلك أجاز المشرع للمحكمة أن تستعين بأهل الخبرة. وتعد الخبرة الفنية في حوادث السير من الأدلة الهامة التي يلجأ إليها القضاء لتقرير مدى مسؤولية أطراف الحادث، وبالتالي توزيعها فيما بينهم وفق نسبة مساهمة كل منهم في وقوع الضرر. وتلجأ المحاكم إلى الخبرة الفنية نظرا لصعوبة تقييم الأخطاء بمعزل عن دراسة مكان الحادث وكيفية وقوعه وفق ظروف الزمان والمكان. وتثير الخبرة الفنية في حوادث السير إشكالا هاما، يتعلق بمدى إلزامية هذه الخبرة التي تلجأ إليها المحاكم في نتائجها بصدد الدعوى المنظورة أمامها. The verification of the facts in question may require investigation of matters that the judge is not aware of, such as medical, engineering, accounting or traffic accidents, so the legislator has authorized the court to use the expertise. The technical expertise in traffic accidents is an important evidence used by the judiciary to determine the extent of the responsibility of the parties to the accident, and therefore to distribute them among themselves according to the proportion of their contribution to the damage. The courts resort to technical expertise because of the difficulty of evaluating mistakes independently of the study of the location of the accident and how it occurs according to the circumstances of time and place. The technical expertise in road traffic accidents poses an important problem with respect to the extent to which this experience, which the courts resort to in its findings, is required in respect of the case before it. |
