| 520 | |a يتناول هذا العمل الجوانب القانونية المتعلقة بأطروحات الدكتوراه الإلكترونية وبالتحديد تلك المرتبطة بحقوق المؤلف والملكية الفكرية المادية منها والمعنوية والتي تعتبر سارية المفعول بعد مناقشة الأطروحة وهذا لضمان حماية حقوق الدكتور. هذا الأخير، يحتفظ بهذا الحق أيضا في حالة البث عبر الإنترنت وخاصة بالنسبة الإتاحة المفتوحة وهذا إما عن طريق أرشيف مفتوح أو عبر ترخيص مجاني أي Creative Commons. أضف إلى ذلك ضرورة احترام هذا الحق بالنسبة لجميع المصنفات المستخدمة في سياق تحقيق الأطروحة وهذا يتسنى بتطبيق الاستثناءات المتعلقة بحقوق المؤلف لتجنب الوقوع في السرقة العلمية. الدكتوراه الإلكترونية، لسرقة العلمية. | ||
| 520 | |b This work deals with the legal aspects of electronic theses which mainly concern copyright and its moral and patrimonial aspects. It’s applying to the thesis after the defense to protect the work of the doctor. It also retains this right to broadcast over the Internet in open access either in an open archive or via a free license "Creative Commons". This same right must also be respected for all the documents used in the context of the thesis realization by applying the exceptions of copyright such as the short quotation and the educational exception to avoid plagiarism. | ||
| 520 | |d Ce présent travail aborde les aspects juridiques afférents aux thèses électroniques qui concernent principalement le droit d’auteur. Ce dernier se caractérise par un aspect moral et un autre patrimonial qui s’applique à la thèse après la soutenance pour protéger l’oeuvre du docteur. Il conserve aussi ce droit quant à la diffusion sur Internet en libre accès soit dans une archive ouverte ou par le biais d’une licence libre « Creative Commons ». Ce même droit doit être également respecté pour tous les documents utilisés dans le cadre de la réalisation de la thèse en appliquant les exceptions du droit d’auteur : "la courte citation" et "l’exception pédagogique" pour éviter de tomber dans le plagiat. | ||
