| المستخلص: | L’Algérie a adopté la liberté de constituer des associations dans la constitution de 1996, modifiée et complétée. Cependant, c’est à la loi d’organiser son exercice. La loi N⁰ 12/06, promulguée dans le cadre de la réforme démocratique, a introduit la déclaration qui est la version la plus atténuée du régime préventif pour l’exercice des libertés publiques et la plus compatible avec la liberté d’association. Malheureusement, exiger de l’association d’avoir le récépissé d’enregistrement de l’administration, pour commencer son activité, a changé le sens de la déclaration qui s’est transformée en autorisation implicite limitant ainsi l’exercice de la liberté d’association. تبنت الجزائر حرية تأسيس الجمعيات صراحة في دستور 1996 المعدل والمتمم، وتركت تنظيم ممارستها للقانون. صدر القانون رقم 12/06 في إطار إصلاحات ديمقراطية، وأخذ بالتصريح كأخف صور النظام الوقائي في ممارسة الحريات العامة وأكثره تماشيا مع حرية إنشاء الجمعيات، غير أن اشتراط حصول الجمعية على وصل التسجيل من الإدارة - لبدء نشاطها - أفقد التصريح معناه وتحول إلى ترخيص ضمني، فقيد بذلك من ممارسة حرية تأسيس الجمعيات.
