| 520 | |a تعتبر براءة الاختراع من أهم حقوق الملكية الصناعية، لذلك سعت اتفاقية تريبس إلى توفير إطار قانوني فعال يحمي الاختراعات ويحفظ حقوق مالكيها عن طريق براءة الاختراع، وهذه الأخيرة تعد الوسيلة القانونية لإضفاء الحماية القانونية على الاختراع موضوع البراءة. وتكمن أهمية هذه الدراسة في محاولة الوقوف على ما جاءت به اتفاقية تريبس بخصوص نظام حماية براءة الاختراع وبالتحديد إشكالية الموازية بين حق المخترع الاستئثاري والشروط التقييدية الواردة عليه، ونحاول في هذا البحث الوقوف على ملامح الحماية القانونية التي حاولت اتفاقية تريبس توفيرها لأصحاب براءات الاختراع، للخروج بنتائج تسد النقص وتعالج القصور في اتفاقية تريبس في تنظيم هذا الموضوع. | ||
