Many activities that were a source of livelihood for many Algerian families, in addition to transportation, universities, schools, and the thing that made the President of the Algerian state issue Executive Decree No. 20-69 of 26 Rajab 1441 corresponding to 21-03-2020 related to measures to prevent the spread of the Corona epidemic Covid 19 and Executive Decree Supplement No. 20-70 of 29 Rajab 1441 corresponding to 03/24-20 identifies complementary measures to prevent and combat the spread of the Corona virus epidemic Covid-19 where these two decrees aim to preserve the security, safety and health of citizens and it is no secret that health epidemics are a material occurrence that has Negative effects on legal relations in general and Contractual relations, in particular, will not be with the suspension of the implementation of some obligations or the impossibility of their implementation, and this is the goal of this research peppier, which is to highlight the impact of the epidemic of Covid 19 on civil and commercial transactions between individuals or between the individual and the state or between the state and other countries. في إطار الظروف التي يعيشها العالم بسبب فيروس كورونا وانتشار السريع خلف هذا الأخير حالة هلع وذعر حيث تسبب هذا الأخير في خسائر كبيرة في جميع المجالات الاجتماعية والاقتصادية والسياسية وحتى القانونية وبهذا نجد معظم دول العالم كانت ملزمة باتخاذ التدابير الضرورية لمحاولة التخفيف من انتشاره كمنع التجمعات والأبعد من ذلك توقيف الدراسة وإغلاق المساجد في الدول الإسلامية وذلك للحفاظ على البشرية على الصعيد العام أما على الصعيد الخاص في الجزائر فمنذ بداية الجائحة في شهر مارس 2020 اتخذت الجزائر جملة من الإجراءات والتدابير لحماية أروح شعبها حيث تم توقيف العديد من الأنشطة التي كانت مورد رزق للعديد من الأسر الجزائرية بالإضافة للنقل والجامعات والمدارس والشيء الذي جعل رئيس الدولة الجزائرية يصدر مرسوم التنفيذي رقم 20- 69 المؤرخ في 26 رجب 1441 الموافق ل 21-03-2020 المتعلق بتدابير الوقاية من انتشار وباء كورونا كوفيد 19 والمرسوم تنفيذي التكميلي رقم 20-70 المؤرخ في 29 رجب 1441 الموافق ل 24- 03- 2020 يحدد تدابير تكميلية للوقاية من انتشار وباء فيروس كورونا كوفيد -19- ومكافحته حيث يهدف هذان المرسومين إلى الحفاظ على أمن وسلامة وصحة المواطنين ولا يخفى أن الأوبئة الصحية واقعة مادية يكون لها آثار سلبية على العلاقات القانونية بوجه عام والعلاقات التعاقدية بوجه خاص ما سيكون معه تعليق تنفيذ بعض الالتزامات أو استحالة تنفيذها وهذا هو هدف هاته الورقة البحثية المتمثل في تسليط الضوء على تأثير وباء كوفيد 19 على المعاملات المدنية والتجارية بين الأفراد أو بين الفرد والدولة أو بين الدولة ودول أخرى. |
