| المستخلص: | استقرار القاعدة القانونية هو الأمن القضائي للحفاظ على الحقوق والحريات فلم يعرفه القانون ولا التشريعات ولا الدستور بل تم توضيح مبادئهما، من مساواة، ووضوح القاعدة القانونية، عدم تناقض النصوص فيما بينها، استقرار العلاقات التعاقدية،... ولا يتأتى ذلك إلا بأمن قانوني، بمعنى عدم تضارب الأحكام إثر تكوين قضاة متخصصين حراس للقانون juge gardien والذي ينعكس على الأمن القانوني، أهمية الموضوع تظهر في تحقيق استقرار القوانين عن طريق الأمن القضائي، والموضوع له أهداف من الناحية الاجتماعية والاقتصادية، يعكس نوعية المجتمع والاقتصاد لهذا يجب على الدول الاجتهاد في هذا المجال.
