| المستخلص: | إذا كانت جودة القضاء تنطلق من حاجة الإنسان إلى نظام قضائي متكامل ومستقل ونزيه، وإذا كانت الرقابة الفعالة ركن من أركان الدولة القانونية، فإن تلك الرقابة لن تتحقق من دون استقلال القضاء وحياده، ونزاهة القضاة، وجودة الأحكام الصادرة عنه. وكل ما تقدم يرتبط بالضرورة بتحقيق الأمن القضائي. ولا بديل عن جودة القضاء لعدم إمكان تقديم الخدمة القضائية إلا من هذا المرفق، وإلا اضطر الإفراد إلى اقتضاء حقوقهم بأنفسهم أو بوسائل غير مشروعة، مما قد ينجم عنه فقدان الثقة بالنظام القانوني للدولة بأكمله. وجودة القضاء تقاس بعدة مؤشرات منها رضا المتعاملين مع المحاكم عن أسلوب وطريقة الأداء فيها، وسهولة الإجراءات، وقرب المواعيد، وحسن تعامل الموظفين والقضاة معهم، وتكامل المرافق والأقسام التي تقدم الخدمة لهم داخل المحاكم، وتهيئة المباني المناسبة، وضمان حقوق المتقاضين في الدفاع عن أنفسهم وتقديم كل ما لديهم من دفوع وأدلة، وحفظ ضمانات العدالة، وتسبيب الأحكام القضائية بشكل جيد، وحماية حقوق المحامين وتوفير الوسائل المعينة لهم على القيام بدورهم إلى غير ذلك من جوانب تعد من معايير الجودة في العمل القضائي. If the quality of the judiciary stems from the human need for an integrated, independent and impartial judicial system, and if effective oversight is an important element of the legal state, then such oversight will not achieved without the independence and impartiality of the judiciary, the integrity of the judges, and the quality of judgments issued by it. All of the above linked necessarily to achieving judicial security, because there is no substitute for the quality of the judiciary because the judicial service provided only by this facility, otherwise individuals are enforced to claim their rights by themselves or by unlawful means, which may result in loss of confidence in the entire legal system of the state. Quality of judiciary is measured by several indicators, including the satisfaction of individuals who deal with the courts about their performance, the easiness of procedures, the proximity of appointments, the good treatment of employees and judges with them, the integration of facilities and departments that provide them with services, the preparation of appropriate buildings, and ensuring the rights of litigants, preserving justice guarantees, causation of judgments, protecting the rights of lawyers and providing them with the means to do their jobs, and other aspects that are considered quality standards in the judicial work. |
