| المستخلص: | The author of this contribution attempts to trace the whole of the jurisprudential contribution of the International Court of Justice in matters of immunity from criminal jurisdiction and criminal responsibility of individuals and more particularly of high-ranking state agents when they are accused of serious international crimes. Since the judgment of 14 February 2012 in the case between the Democratic Republic of the Congo and the Kingdom of Belgium, the Court seems to have laid down a guideline in case-law on the subject. L’auteur de cette contribution tente de retracer l’ensemble de la contribution jurisprudentielle de la Cour internationale de justice en matière de l’immunité de juridiction pénale et de responsabilité pénale des individus et plus particulièrement des agents étatiques de rang élevé lorsque ceux-ci sont accusés de crimes internationaux graves. Car, depuis l’arrêt du 14 février 2012 dans l’affaire opposant la République démocratique du Congo au Royaume de Belgique, la Cour semble avoir posé une ligne directrice dans jurisprudence en la matière. يرمي هذا المقال إلى تحديد المعالم الكبرى للدور الاجتهادي لمحكمة العدل الدولية في مجال الحصانة القضائية الجزائية والمسئولية الجزائية للأفراد أو بالأحرى للأفراد الذين يشغلون مناصب قيادية في الدولة، وذلك عندما يتم متابعتهم علي أساس ارتكاب جرائم دولية الأشد خطورة أمام محاكم الدول غير الدول التي ينتمون إليها. إذ يبدوا جليا بأن محكمة العدل الدولية قد وضعت منذ قرارها المؤرخ في 14 فيفري 2002 في القضية المطروحة بين جمهورية الكونغو الديمقراطية ومملكة بلجيكا، وضعت أسسا تقود اجتهادها في المسائل ذات الصلة بالحصانة القضائية والمسئولية الجزائية لكبار قيادات الدولية المتابعين بجرائم دولية. |
