| 520 | |b The architect is considered one of the most important actors in the field of construction, given his active role, and his intervention takes place through the different stages of the construction process. It also ensures the safety and durability of the buildings and facilities it builds. The Algerian legislator has a certain number of obligations resulting from the breach of the architect's responsibility. These commitments are technical and artistic obligations, and represent the preparation of the architect to study the project, plans and specifications. The architect must assume consultative obligations, both in terms of supervision and monitoring of the implementation of the project and to provide advice to the project owner. In addition to these obligations, the architect has the obligation to take out a civil and professional liability insurance and a ten- year liability. | ||
| 520 | |a يعتبر المهندس المعماري من بين أهم المتدخلين في مجال البناء، نظرا لدوره الفعال، ويكون تدخله عبر مختلف المراحل التي تمر بها عملية البناء بدأ من دراسة المشروع إلى ما بعد تسليمه، ولضمان سلامة ومتانة ما يقوم المهندس بتشييده من مباني ومنشآت رتب المشرع الجزائري جملة من الالتزامات التي ينجم على مخالفتها تحقق مسئولية المهندس. تتمثل هذه الالتزامات في التزامات ذات طابع تقني وفني والمتمثلة في إعداد المهندس لدراسة المشروع والتصاميم والمقاسات، وكما يلتزم المهندس بالتزامات ذات طابع استشاري وإداري سواء من حيث إشراف ومراقبة تنفيذ المشروع، وتقديم النصح والإرشاد لرب العمل. يضاف لهذه الالتزامات التزام المهندس المعماري بالتأمين من مسئوليته المدنية المهنية والعشرية. | ||
