| المستخلص: | يتحدث البحث عن آليات حماية العقار الفلاحي، حيث قسم إلى ثلاثة محاور: الأول خصص للإطار المفاهيمي للعقار الفلاحي، أما المحور الثاني فتناول حماية العقار الفلاحي والمحور الثالث تطرقنا فيه لأساليب تحويل الأراضي الفلاحية واقتطاعها لغرض التعمير، وقد خلصنا إلى أن المشرع الجزائري قد حرص على إبقاء الأرض الفلاحية على طبيعتها ومنع تحويل وجهتها، ورتب عقوبات جزائية وأخرى إدارية على المعتدين عليها. لكن هذه القوانين ظلت حبرا على ورق جراء صعوبة تطبيقها على أرض الواقع، واختراقها من قبل السلطات أنفسهم، وغياب الإرادة السياسية للمحافظة على هذه الثروة واستغلالها الاستغلال الأمثل. This paper focuses on the mechanisms of agricultural estates protection. It is divided into three chapters: the first one is about the notion of agricultural estates, the second examines the protection of agricultural estates, and in the third chapter we tackle the means to transform the agricultural estates to urbanity destination. In conclusion we deduced that Algerian law confirms remaining of the nature of agricultural properties by forbidding their transforming, it provides criminal and administrative sanctions on the aggressors. However these laws are not applicable on the ground for they are difficult to be exercised, and because of their violation by the government itself, and finally because of the lack of political will to safeguard and best exploit these resources. |
