| المستخلص: | لم يعهد تاريخنا الإسلامي أية مناقشة صريعة لمسألة صلاحية الشريعة الإسـلامية للتطبيق، حيث كانت الشريعة تطبق في مجالات الحياة المختلفة بسلاسة دون أن يشعر المسلمون بالحاجة إلى أي مصدر آخر، رغم توسع رقعة الدولة الإسلامية وكثـرة المستجدات فيها. اليوم يثور جدل غير مسبوق بسبب موجة التشكيك التي جاءت كأثر من آثار الغزو الثقافي الذي رافق الغزو العسكري لبلادنا، مع وجود حالة من التصدع في البنية الثقافية لمجتمعاتنا، إضافة إلى التجارب المعاصرة المحدودة المرتبكة والتي لم تقدم النموذج المقنع للتطبيق لحد الآن. يتناول هذا البحث هذه المسألة بهذا البعد وبالمنظورين: العقدي والعملي، فيشرح مكانة الاعتقاد بصلاحية الشريعة الإسلامية للتطبيق وأسسه التي يقوم عليها، ثم يعـرج على الشروط والمقدمات النظرية والعملية التي لابد من تحققها قبل التطبيق وأثناءه، والتفريق بين هذه المسالة باعتبارها لازما من لوازم العقيدة وبين التجارب البشرية المعرضة للإخفاق والفشل، وهذا من أهم ما ينبغي ذكره هنا من نتائج البحث؛ أن صلاحية الشريعة للتطبيق لا تعني تقديم ضمانة بنجاح التطبيق، فالتطبيق مسؤولية بشرية تستند أساساً في جانبها العملي على الجهد البشري وخبراته المتراكمة، ومن هنا ينبغي الاعتراف بأننا بأحسن الأحوال إنما نقدم تجربة بشرية أرضية مستندة إلى السماء ولا نقدم تجربة سماوية مقدسة أو معصومة، ولذلك فمناقشة الشبهات المبدئية حول تطبيق الشريعة لا يكون مجدياً ما لم يتم بجث شروط التطبيق وآلياته، والاحتمالات التي تنتظر أية تجربة من هذا النوع في ظل قراءة الواقع والظروف المحيطة محلياً وإقليمياً وعالمياً. Our Islamic history gave no explicit discussion of the validity of Islamic law as Sharia had been applied smoothly in different areas of life with no need to refer to any other source despite the expansion of the Islamic State and its many developments. Recently, there is an unprecedented controversy because of the wave of skepticism that came as a result of the cultural invasion accompanied the military invasion of Arab countries, with a rift in the cultural structure of our societies, in addition to the limited contemporary experiences that have not yet applied a convincing model. This research explores this issue in this dimension and with two perspectives: the creedal and the practical. It explains the position of belief in the validity of Sharia and its foundations, and then lays down the conditions and the theoretical and practical prerequisites that must be achieved before and during the application, distinguishing this issue as a necessary provision of faith from human experiences which is prone to fail. This is one of the significant results of this research, which is the validity of the Sharia for application does not mean guaranteeing the success of application, as it is a human responsibility based primarily on its practical aspect on the human effort and accumulated experience. Hence one should admit that what is presented is a human experience based on divine not as a holy experience. Therefore, discussing the initial suspicions regarding the application of Sharia is not feasible unless the conditions and mechanisms of the application are discussed, and the possibilities that await any such experiment in light of reading the reality and the surrounding conditions locally, regionally and globally. |
