| المستخلص: | On the sixteenth of Rajab of the current year 1441H, the World Health Organization (WHO) declared the new Corona Virus (COVID-19) a global epidemic, and recommended that all necessary precautions and procedures be taken. Hence lies the importance of this study, which aimed to demonstrate the jurisprudence (Fiqh) conditioning of the criminal responsibility arising from transmitting infection with Corona epidemic (COVID-19), as well as the elements, images and ruling on causing the transmission of this epidemic deliberately or by mistake, and evidence proving such responsibility. The study concluded with certain results, including: Establish the criminal responsibility on whoever deliberately transmits the infection with this epidemic for the purpose of causing public or private damage, or caused wrongful transmission of infection to the victim and led to his death by negligence and carelessness from him, or because of his violation of the regulations and instructions, he has to expiate from his money, and his relatives have to pay blood money. The study recommended the necessity of communication between the medical authorities and legal bodies to issue health fatwas in cases of epidemic diseases, the need to adhere to the regulations and instructions issued by the competent authorities, and the need to update health requirements to protect the community health from epidemic diseases. أعلنت منظمة الصحة العالمية في السادس عشر من شهر رجب من العام الحالي 1441ه فيروس كورونا المستجد (COVID-19) جائحة عالمية، وأوصت باتخاذ جميع الاحتياطات والإجراءات الاحترازية اللازمة، ومن هنا جاءت أهمية هذه الدراسة التي هدفت لبيان التكييف الفقهي للمسؤولية الجنائية الناشئة عن العدوى بجائحة فيروس كورونا المستجد (COVID-19)، وأركانها، وصورها، وحكم التسبب بنقل هذا الوباء عمدا أو خطأ، وأدلة إثبات موجباتها. وقد انتهت الدراسة إلى نتائج، من أهمها: ترتب المسؤولية الجنائية على من تعمد نقل الفيروس على وجه الإفساد العام أو الخاص، أو تسبب بنقل الفيروس خطأ للمجني عليه وأدى إلى موته بتفريط وإهمال منه، أو بسبب تجاوزه للأنظمة والتعليمات، فإن عليه الكفارة في ماله، والدية على عاقلته. وأوصت الدراسة بضرورة التواصل بين الجهات الطبية، والهيئات الشرعية، لإصدار الفتاوى الصحية في حالات الأمراض الوبائية، وضرورة الالتزام بالأنظمة والتعليمات الصادرة من الجهات المختصة، وضرورة تحديث الاشتراطات الصحية حماية لصحة المجتمع من الأمراض الوبائية. |
