| 520 | |a إن إقامة شيء مكان آخر فيما يبذل في مقابلة غيره بين أطراف العلاقة التعاقدية، والذي وضعت له عنوانا "فقه الإبدال في المعاوضات- دراسة تأصيلية تطبيقية" لم تتفق فيه وجهة نظر الفقهاء دائما، وظهر الاختلاف واضحا في الفروع الفقهية، ومن ذلك الإبدال في الأثمان والمبيع والسلم والصرف، وإن ظهر اتفاق الفقهاء في الإبدال في القيميات والمثليات والإجارة، ولأهمية هذه المسائل جاء البحث ليكشف عن الأحكام الفقهية للإبدال في المعاوضات، ثم ليربطها ببعض الصور المعاصرة ذات الصلة.\nوقد استوعب البحث تمهيدا وسبعة مطالب عرضت من خلالها آراء الفقهاء اتفاقا وافتراقا وأظهرت رأيي حيث المقام يستدعي ذلك ثم ختمت البحث بأهم النتائج.\n | ||
| 520 | |f The establishment of something at the place of others that is spent against the other between the parties to the contractual relationship, which has been entitled “Jurisprudence of substitution in the trade-offs - an original and applied study” in which the point of view of jurists did not always agree. The difference is evident in the branches of jurisprudence, including the substitute in prices, sales, Bai Salam (an Islamic contract in which full payment is made in advance for specific goods to be delivered at a future date) and Bai Saraf (Exchange of gold and silver, provided that the commodities and received before the parties depart from the meeting), although jurists have agreed on substitution in values, the compensation right and leasing. Given the importance of these issues, the study seeks to reveal the jurisprudence provisions for substitution in trade-offs, and then to link them to some related contemporary images. \nThe research includes a prelude and seven chapters through which the opinions of jurists of agreement and disagreement have been presented. \nI expressed my opinion where needed and then concluded the research with the most important results.\nThis abstract translated by Dar AlMandumah Inc. 2020 | ||
