| 520 | |a تتناول هذه الدراسة عبء إثبات الدعوى الإدارية في النظام السعودي، من خلال توضيح ماهية الإثبات الإداري أمام القاضي الإداري بتبيان مفهوم الإثبات الإداري وأهميته وصعوبته ووسائله، كذلك من خلال العوامل التي تؤثر في الإثبات الإداري وتجعل جهة الإدارة الطرف الأقوى في الدعوى الإدارية، والكشف عن امتيازات الجهة الإدارية، وأثر هذه الامتيازات على عبء الإثبات، وأخيرا تقف الدراسة على الدور الإيجابي للقاضي الإداري في الدعوى الإدارية، من خلال معاينة القاعدة العامة في عبء الإثبات ومدى ملاءمتها للدعوى الإدارية، والدور الإجرائي والموضوعي للقاضي في الإثبات وإدارة الدعوى. | ||
| 520 | |b This study deals with the burden of proving administrative proceedings in Saudi law by clarifying the notion of administrative evidence before the administrative judge through elucidation of its concept, importance, difficulties and means. The study also does so through explanation of the factors that affect administrative evidence which makes management the strongest party in administrative proceedings, as well as through the disclosure of the privileges of the administrative side and their impact on the burden of proof. The study equally sheds light on the positive role of the administrative judge in the administrative case by examining the general rule that governs the burden of proving and its appropriateness for administrative proceedings. This is added to emphasizing the procedural and substantive role of the judge in proving and managing the case. | ||
