| المستخلص: | إن سلطة التشريع في الإسلام مقيدة بالتزامها بنصوص الوحي، كما أن الشريعة صالحة للتطبيق في كل زمان ومكان، ولا مخرج للأمة الإسلامية مما تعيشه من فوضى وفساد إلا بتطبيق أحكام الشريعة الإسلامية، والتشريع الإسلامي بمعنى السلطة غير المحدودة لا يملكها أحدا من البشر فكل سلطة إنسانية محدودة بالحدود التي فرضها الله تعالى فهو وحده صاحب السيادة العليا وإرادته هي شريعتنا التي لها السيادة في المجتمع. سنتناول في هذا البحث سلطة التشريع في الإسلام ومدى حق ولي الأمر في التشريع، ومن هي السلطة المخولة اليوم بالتشريع وما هي الاتجاهات التي سلكتها الدساتير العربية في بيان سلطة التشريع ومن يملكها وسنوضح بالتفصيل سلطة التشريع في الدستور اليمني كأنموذج لبيان سلطة التشريع. وسنتناول هذه الأمور في مبحثين نتناول في المبحث الأول سلطة التشريع في الإسلام ثم نتناول في المبحث الثاني اتجاهات الدساتير العربية وسلطة التشريع في الدستور اليمني. The authority of legislation in Islam is restricted by its commitment to the texts of revelation. The sharia is valid for every time and place. There is no way out for the Islamic nation from the chaos and corruption it is living in, except by the application of the laws of Islamic sharia. Islamic legislation in the sense of unlimited power does not belong to any human being. Every human authority is limited by the restrictions imposed by the Almighty Allah. He alone is the supreme sovereign and His will is our law, which has sovereignty in society. In this paper, we will discuss the authority of legislation in Islam and the extent of the guardian's right to legislate, who is the authority empowered today to legislate, and what trends have been taken by Arab constitutions in the statement of legislative authority and who owns it? We will explain in detail the authority of legislation in the Yemeni constitution as a model for the statement of the authority of legislation. We will study these issues in two sections. The first section deals with the authority of legislation in Islam. Then, the second section discusses the trends of Arab constitutions and the authority of legislation in the Yemeni constitution. |
