| المستخلص: | In the name of Allaah the Merciful, Praise be to Allah, and thanks to Him for His favours, and peace and blessings be upon His Prophet, Muhammad and his family and companions. This research contains the investigation of part of a book on Hambali Fiqh (Jurisprudence), which is a commentary on "Al-Muharrar", by Safiyyuddeen Al-Qatee'e. The part investigated in this research is the Chapter on Returning Sold Goods Due to Defect, in the Book of Sales. The research was divided into two sections: the first section: the study of the book and the author, and the second section: the investigated text. The study section includes the most important topics related to the investigated text and its author, and the commentary and its author, as well as the study of the manuscript and what has been investigated and what remained, and then followed by the investigation of the said part, according to the extant scholarly method of manuscript investigation. The aim of this research was to contribute in unveiling part of our Islamic heritage, and to disseminate it to the students of knowledge, as intended by its author. The completion of the work shows the significance of the book and the virtue of its author, and his great reputation as a scholar, not only in Fiqh, but also in various fields of knowledge; hence, he was an authority for students of knowledge during his era. May Allah have mercy on him and forgive him. Also his book is a commentary on one of the most important books of the Hambalis, and the commentary is distinguished by his interest in demystifying the intention of the original author and his proof for the rulings he establishes therein. I ask Allaah to bless this work and to make it sincere solely for Him. May Allaah bless our Prophet Muhammad and his family and companions in general. بسم الله الرحمن الرحيم، الحمد لله حق حمده، والشكر له على فضله، والصلاة والسلام على نبيه وخله، محمد وعلى آله وصحبه، أما بعد: فهذا بحث يشتمل على تحقيق جزء من كتاب فقهي حنبلي، وهو شرح المحرر، لصفي الدين القطيعي، والجزء الذي حققته في هذا البحث هو باب الرد بالعيب من كتاب البيوع. وقد قسمت البحث إلى قسمين: القسم الأول: دراسة الكتاب والمؤلف، والقسم الثاني: النص المحقق. اشتملت الدراسة على أهم المباحث المتعلقة بالمتن ومؤلفه، والشرح ومؤلفه، كما اشتملت على دراسة المخطوط، وما حقق منه وما بقي، ثم أتبعت ذلك بتحقيق الجزء المذكور، وفق المنهج العلمي المتبع في تحقيق المخطوطات. وكان الهدف من هذا البحث المشاركة في إظهار جزء من تراثنا الإسلامي، ونشره لطلاب العلم، على وفق ما أراد مؤلفه. وتبين بعد اكتمال العمل أهمية الكتاب وفضل مؤلفه، وعلو شأنه في العلم، ليس في الفقه فحسب بل في شتى العلوم والفنون، فكان في زمانه مرجعا لطلاب العلم. رحمه الله وغفر له، كما أن كتابه شرح فيه أحد أهم كتب الحنابلة، وتميز الشرح باهتمامه ببيان مراد الماتن واستدلاله على ما يقرره من أحكام. أسأل الله أن يبارك في هذا العمل إن يجعله خالصا لوجهه الكريم. وصلى الله وسلم على نبينا محمد وعلى آله وصحابته أجمعين. |
