| 520 | |b Since Shari'ah (Islamic law) safeguards people's interests in all facets of their life, and takes into consideration their customary ways of trading, in as much that such ways are not harmful to them; hence, the utmost attention given by the scholars of the past and the present to people's customary practice. Based on this, the foregoing research focuses on compiling people's customary practices on issues of trade as narrated by Sheikh Muhammad Al-'Uthaymeen in his book named: "Ash-Sharh Al Mumti' ", with an explanation on the proof of such practices and their source, including whoever is in support of them among the Islamic jurists; in order that such would help in attaching due consideration to those practices from both jurisprudential and judicial perspectives. The "people's customary practice" in this research is means: The jurisprudential opinion that most people or a group of them have adopted in their trades; based on the ruling of a judge or the opinion of a respected scholar. The number of issues on which Sheikh narrated people's customary practice is up to 26 issues. Finally, the research was concluded with a summary and the opinions of Islamic jurists, with a recommendation on giving due consideration to people's customary practice on the foregoing topic through further highlight and study | ||
| 520 | |a لما كانت الشريعة حافظة لمصالح الناس في نواحي حياتهم، مراعية لما يتعاملون به في بيوعهم ما لم يكن فيه مفسدة لهم، كان عمل الناس محل عناية لدى كثير من الفقهاء قديما وحديثاً ولذا كان هذا البحث في جمع ما عليه عمل الناس في باب البيوع مما حكاه الشيخ محمد العثيمين في شرحه الممتع، مع بيان وجه ذلك القول ومأخذه، ومن قال به من الفقهاء؛ ليكون معينا على مراعاته والعناية به في النظر الفقهي والقضائي. والمراد بعمل الناس في هذا البحث هو: القول الفقهي الذي أخد به عامة الناس أو طائفة منهم في معاملاتهم؛ بناء على حكم حاكم أو قول عالم معتبر. وقد بلغت عدد المسائل التي حكى الشيخ فيها العمل: ستة وعشرين مسألة، وقد ختمت هذا البحث بخلاصة لها ومذاهب الفقهاء فيها، مع التوصية بالعناية بما جرى عليه عمل الناس في هذا الباب، وإبرازه ودراسته. | ||
