| المستخلص: | تناول البحث قضية اليسر في الشريعة وهي مهمة من قضايا فقه المقاصد في الشريعة الإسلامية. ويطلق اليسر على معان لغوية تدور حول السهولة والانقياد واللين والتهيئة بعيداً عن كل ما من شأنه حرج ومشقة. وأما اليسر اصطلاحاً فهو: (الالتزام بأحكام هذا الدين كما أرادها رب العالمين ثم التعامل مع هذه الأحكام والتشريعات وفق منهج اليسر الذي تتبين معالمه من خلال المنهج النبوي الكريم). وهذا المنهج كان واضحاً في سنته وهديه صلى الله عليه وسلم من خلال أقواله وأفعاله وجميع سيرته عليه الصلاة والسلام. وقد تطرق البحث ما يدل على تيسيره وسماحته (ورفع الحرج عن أمته) وما يدل على خشيته (أن يكون قد شق على أمته) وأيضا ما يدل على أمره لأمته (التخفيف واليسر في الدين وعدم التعمق والتشديد فيه وإنكاره ذلك عليهم). وورد التيسير ورفع الحرج في الشريعة على قسمين: في مجال الأحكام الأصلية الثابتة وفي مجال الأحكام الفرعية الطارئة. كما تطرقنا إلى أسباب التيسير ورفع الحرج في الشريعة الإسلامية وتمثلت في (الضرورة - الحاجة - المرض - السفر - النسيان أو السهو عن الشيء). The study has dealt with the issue of the facilitation in Sharia which is important in the issues of objectives of Fiqh in Islamic Sharia. Facilitation has many linguistic meanings that revolve around ease, control, softness and configuration, in which they are away from everything that is regarded as embarrassment and hardship. Facilitation is terminologically defined as, "commitment to the provisions of Islamic religion as wanted by Allah, and then to deal with these provisions and legislations in accordance with the facilitation method as it has been clarified in the Prophet's methodology". Sunnah and guidance of the Prophet (pbuh) are clear in his methodology, and they can be seen in his words, deeds and biography. This study has discussed the evidence of his facilitation and tolerance on order to lift (the embarrassment of his nation), his apprehension from making (hardship on his nation), and his command to his nation to make (mitigation and facilitation in religion; i.e. his followers should not get deeper in religion, and they should never deny this act.) Facilitation and embarrassment lifting in Sharia are divided into two parts: the original fixed provisions and the sub-emergency provisions. We have also discussed the reasons of facilitation and embarrassment lifting in Islamic Sharia, which can be seen in (necessity, need, illness, travel, forgetfulness or slip of memory). |
