| المستخلص: | تناولنا هذا البحث من خلال بيان مفهوم المسؤولية الجنائية، ومفهوم الصحافة الإلكترونية، وبيان أركان وشروط هذه الجريمة، وبيان مفهوم المساهمة الجنائية في هذه الجريمة في كل من الفقه والنظام، والعقوبة المقررة لها وللمساهمين فيها، وقد خلصنا إلى أنه متى ما ارتكبت الأفعال المكونة لجريمة الصحافة والنشر الإلكتروني، وتوافر الركن المعنوي المبني على العلم والإرادة، وتحققت النتيجة الإجرامية وقيام علاقة السببية بين الفعل والنتيجة، فإننا نكون بصدد جريمة تامة تستوجب مسؤولية فاعلها وكل من أسهم في ارتكابها. كما خلصت إلى أن علم الجاني في هذه الجريمة مفرتض؛ لأن الجاني لا يزاول مهنة الصحافة بشتى أنواعها وأشكالها إلا إذا كان عالما بما يجوز نشره ومالا يجوز، ومع ذلك فإذا كان العلم مفترضا، فيبقى تحديد الإرادة ومدى دخل الناشر فيما نشر، وهل كانت إرادته حرة، أم كان مجبرا تحت ضغط من رئيسه أو إكراه من أي نوع، وهذه المسائل يستخلصها قاضي الموضوع من معطيات القضية والأدلة المطروحة أمامه. وقد رأيت أن مناط المسؤولية الجنائية في إطار جريمة الصحافة الإلكترونية مفترض، ذلك أنه لا يعقل اشتغال الصبي أو غير المميز أو المجنون بمجال الصحافة والنشر وهو غير مؤهل لذلك، وإن كان من الممكن تصور ذلك، إذا ما جرى استخدام شخص ناقص الأهلية أو مجنون في نشر مخالفات أو التشهير بآخرين أو ما شابه ذلك. كما أن المنظم افترض توافر القصد الجنائي في كل المساهمين في ارتكاب هذه الجريمة، لأنه باجتماعهم على ارتكاب فعل أو الامتناع عن فعل، قد ذهبت إرادتهم الحرة المختارة لارتكاب ماديات الجريمة، وإرادة إحداث النتيجة الإجرامية. ولذلك فقد أرسى النظام السعودي دعائم الاشتراك والمساهمة في الجريمة الصحفية بما فيها جريمة الصحافة الإلكترونية، حيث بينت نصوص الأنظمة المختلفة الأشخاص الذين يخضعون للمسؤولية الجنائية عن جرائم الصحافة بصفة عامة، وعدهم النظام فاعلين أصليين.
