| المستخلص: | لقد دأبت البلدان الغنية بالموارد الطبيعية على انتهاج السبل الناجعة والكفيلة للاستخدام الأمثل لمواردها من أجل دفع عجلة التنمية الاقتصادية والاجتماعية ويتم ذلك بواسطة أبرام العقود من قبل حكومات هذه الدول مع شركات النفط الأجنبية وبيع النفط وألغاز، وتكمن أهمية الموضوع فى العمل من قبل حكومات الدول المنتجة، للوصول إلى النتائج المرجوة من العقد بهدف تحقيق أفضل الأرباح الممكنة، وتعتبر الدول المنتجة للنفط الطرف الأهم فى عقود التراخيص النفطية باعتبارها الجهة المالكة للاستثمار حسب القانون وبالتالي على الحكومة استخدام سلطتها القانونية للمتابعة والمراقبة على عقود التراخيص النفطية لغرض حماية المصلحة العامة من خلال العقد، وللدول المنتجة صورتان لأبرام عقد الترخيص النفطي، الصورة الأولى: كونها أحد أطراف العقد والتي تهدف من خلاله مضاعفة إيراداتها وحماية مصالحها أمام شركات النفط الأجنبية، أما الصورة الثانية فهي رقابة الحكومة على مجمل العقد ومطابقته للشروط التي أتفق عليها بين أطراف العقد.
