| المستخلص: | هذه الدراسة يدور محورها حول حديث شكوى امرأة صفوان بن المعطل زوجها إلى النبي صلى الله عليه وسلم، والقصد منها بيان صحة الحديث الوارد في ذلك، ودفع ما ورد عليه من اعتراضات، وفندت قول من ضعفه، مع التنبيه على بعض الهنات لبعض الأفاضل، مع بيان الصواب ودفع ما يرد عليه من تعارض، كما تضمنت الدراسة عدة مباحث تتعلق باستنباط فوائده، فبدأت ببيان معاني كلماته واختلاف رواياته، ثم ذكرت عدة فوائد استنباطها من الحديث مدعماً كل فائدة بما يؤكدها من أحاديث آخر، وكان من أهم هذه الفوائد، جواز شكاية المرأة زوجها بقصد دفع ضرر أو إصلاح تقصير، وعلى المشكولة سماع قول المدعى عليه قبل القضاء، مع بيان الفرق بين القضاء والفتوى، ووجوب التثبت عند سماع الأخبار، وعدم التسرع في إطلاق الأحكام، وبيان عظمة هذا الدين، ومن جوانب عظمته مراعاة التوازن بين الحقوق والواجبات، وأن المرأة لا تصوم نفلاً ولا واجباً موسعاً وزوجها حاضر إلا بإذنه، وأن من فاتته صلاة من غير تفريط فهو معذور، ويجب عليه القضاء، على اختلاف بين العلماء هل يجب على الفور أو على التراخي، ومشروعية إنكار المنكر وجواز الاستعانة بالغير على تغييره، وأن للحديث سبب ورود كما أن للآيات سبب نزول، مع بيان أهمية معرفة السبب في فهم النص الشرعي. And after: this modest study revolves around the hadith of the complaint of the woman of Safwan Ibn Al-Mu’atal her husband to the Prophet, may Allah’s prayers and peace be upon him, and its purpose is to explain the authenticity of the hadith contained in it, and to pay what was said against him, then extract some of its benefits and its derivatives, this research included an introduction And two studies with indexes, so the introduction included an optional reason for this research and my methodology in the study, and as for the first topic: translation included it for the owners of the story, the text of the hadith with the authority of Abu Dawud, a statement of who brought it from the imams, a study of its chain of transmission and a statement of its degree, and confirmed what was reached by the words of the imams, then refuted the saying Of his weakness, with alerting some of the the goofs to some virtues, with Yan right and pay what is given him from a conflict. As for the second topic: it included several topics related to eliciting its benefits, so I began by explaining the meanings of his words and the difference in his narratives, and then mentioned several benefits he derived from the hadith in support of each benefit with what he confirms from other hadiths, citing the words of the scholars on the issue, and one of the most important of these benefits was the permissibility of the woman’s complaint Her husband with the intention of paying harm or fixing a default, and the complainant must hear the defendant’s statement before the judiciary, with a clarification of the difference between the judiciary and the fatwa, and the necessity of verification when hearing the news, and not to rush to release judgments, as the matter may be contrary to what was heard, and to clarify the greatness of this debt, One aspect of its greatness is taking into consideration the balance between rights and duties The woman does not fast a naafil or an obligatory duty, and her husband is present only with his permission, and if he misses a prayer without neglecting it, then he is excused, and he must eliminate, a difference between scholars, whether it is necessary immediately or indolence, and the legitimacy of denial of wrongfulness and that it is permissible to seek the help of others to change it, and that to talk Reason for receipt, as the verses have a reason for descent, with an indication of the importance of knowing the reason in understanding the legal text, then I mentioned other benefits in a nutshell. |
