| 520 | |a متى ما انتقلت ملكية العين المؤجرة إلى غير المستأجر وكان الإيجار نافذاً في مواجهة المالك الجديد اكتسب الأخير صفة المؤجر كما لو كان طرفاً في ابرام عقد الإيجار. وعلى ذلك ينتقل الإيجار تبعاً الانتقال ملكية المأجور، وأثر ذلك أن المالك الجديد يحل محل المؤجر في الحقوق والالتزامات، فيكون للأخير الحق في مطالب المستأجر بالوفاء بالأجرة والقيام بالإصلاحات التأجيرة. أما المستأجر يكون له الحق في مطالب المالك الجديد بتمكينه من الانتفاع بالمأجور بأن يلتزم بتسليم المأجور، والقيام بالإصلاحات الضرورية، وضمان التعرض والاستحقاق، وضمان العيوب الخفية. أما بالنسبة لعلاقة المؤجر بالمستأجر فلا يحق لأحدهما الرجوع على الآخر بشي لانتهاء العلاقة الإيجارية بينهما، إلا ما نشأة من حقوق والتزامات ترتبت في ذمة أحدهما أو كلاهما في مواجهة الآخر في وقت سابق على انتقال ملكية العين المؤجرة، على ذلك للمستأجر الرجوع على المؤجر عن الأجر التي قام بتعجيلها للمؤجر عن المدة التالية لانتقال ملكية المأجور. وله الحق في الرجوع على المؤجر بالمصروفات التي أنفقها المستأجر على المأجور بحسب نوع هذه المصروفات. كما قد يكون للمؤجر الحق في الرجوع على المستأجر بالأجرة المستحقة عن انتفاع المستأجر في المأجور عن المدة السابقة على انتقال ملكية المأجور، أو يرجع على المستأجر بقيمة الأضرار الناتجة عن فعل المستأجر قبل انتقال ملكية المأجور. | ||

And has the right to refer to the lessor the expenses spent by the tenant on the leased thing according to the type of these expenses. The lessor may also have the right to refer to the Tenant for the rent due from the lessee's use of the leased thing in the period prior to the transfer of ownership of the rent or to the tenant for the damage caused by the act of the tenant prior to the transfer of ownership of the leased thing. | ||
