| المستخلص: | أهداف البحث: إبراز إحدى صور دفع الضرر العام بارتكاب الخاص، ونشأة التقعيد الأصولي والفقهي من خلال دراسة القاعدة، دراسة تكشف عن معانيها، وتعرف بمصطلحاتها، وتبين معناها الإجمالي، مع بيان أهميتها وأثرها في الفقه الإسلامي، وما تقدمه للأصوليين والفقهاء من حلول لعدد من النوازل، ومن ثم تحديد ضوابط إعمالها، ومناقشة وجهات النظر لتلك القضية، وإيراد أمثلة من تطبيقات القاعدة في فروع الفقه الإسلامي. منهج البحث: هو المنهج الاستقرائي التحليلي القائم على إيضاح مفردات القاعدة، ومعناها الإجمالي، ثم تحديد ضوابط إعمالها، والإشارة إلى أهميتها وأثرها في الفقه الإسلامي، واستقراء نصوصها، وصيغها عند الأصوليين والفقهاء، مع استقراء لتطبيقاتها عند الفقهاء. أهم النتائج والتوصيات: ظهر من نتائج هذا البحث: أن أهم أصول الشريعة اعتبار مصالح الناس ودرء المفاسد عنهم، وأن السنة النبوية أحد المصادر الأساسية لتكوين القاعدة الأصولية، ومفهوم القاعدة: هو أنه عند تعارض ضررين أو مفسدتين: أحداهما خاص بفرد أو جماعة أو طائفة، والآخر ضرر عام بجماعة المسلمين، ولابد من ارتكاب أحدهما لدفع الضرر الآخر فيرتكب الضرر الأخف وهو الضرر الخاص، ولا يرتكب الضرر الأشد وهو الضرر العام، وألفاظها وإن كانت متفاوتة في الثبوت والأسلوب، إلا أنها متفقة في المعنى والدلالة، والعبارة المستقرة عند أكثر الأصوليين، هي العبارة العامة الشمولية: "درء المفسدة العامة بارتكاب المفسدة الخاصة"، وانحصار هذه القاعدة في أبواب المعاملات لا يخل بكليتها، والعمل بها يستلزم مراعاة الضوابط المشار إليها لإعمالها، وأنها من القواعد الأصولية التي يستصحب نصها وتتداول عباراتها لدى أهل الفتوى والاجتهاد عند بحثهم عن حلول لبعض النوازل والقضايا المستجدة. وأهم التوصيات: عمل موسوعة للقواعد الأصولية تشتمل على دراسات تأصيلية تطبيقية، وضرورة الربط بين مقاصد الشريعة وفروع الفقه الإسلامي. The research methodology is the analytical inductive method based on clarifying the vocabulary of the rule, its general meaning, then defining the controls of its implementation, pointing to its importance and its impact on Islamic jurisprudence, and extrapolation of its texts and its .formulas among the fundamentalists and jurists. The main findings and recommendations: The results of this research: The most important assets of the law to consider the interests of the people and prevent the evils of them, and that the Sunnah is one of the basic sources of the formation of fundamentalist rule, and the concept of rule: is that when the conflict of two things or spoilers: And the other is a general harm to the Muslim community, and one must be committed to pay the other harm.
