| المستخلص: | The family is the primary unit in the building of every society, and any prejudice to it is considered to be an infringement on society. Therefore, the Algerian legislator has provided the family with special penal protection, as is the case with various Arab legislations. Among the crimes against the family, that directly affect its existence, is the crime of “negligence towards pregnant wife,” given its negative effects on both the child and the wife as well. The Algerian legislator aims to criminalize this act as there must be a protection for the future child and the mother of tomorrow. In addition to criminalizing abortion to protect the fetus, the latter is given greater protection by criminalizing the act of neglecting the pregnant wife, given the seriousness of this act for the health of the fetus on the one hand and the psyche of the mother on the other.\nThis abstract translated by Dar AlMandumah Inc. 2018 Cellule de base de la famille est la construction de toute société, et que tout le préjudice qui leur est considérée comme une violation de la communauté, si distingué le législateur algérien, pénal de protection de la famille en particulier comme les différentes législations arabes et ont été parmi les crimes urgents de la famille, affectant un impact direct sur le crime d'existence de « négligence une femme enceinte, « où ils touchent les enfants et ses méres, et très législateur algérien ici derrière la criminalisation de l'acte. تعتبر الأسرة الخلية الأساسية في بناء كل مجتمع، وأن أي مساس بما يعتبر مساسا بالمجتمع، لذلك خص المشرع الجزائري الأسرة بحماية جزائية خاصة شأنه في ذلك شأن التشريعات العربية المختلفة ومن تم كانت من بين الجرائم الماسة بالأسرة والمؤثرة تأثيرا مباشرا على وجودها جريمة" إهمال الزوجة الحامل " حيث أنها تمس بالطفل والزوجة، وغاية المشرع الجزائري هنا من وراء تجريمه لهذا الفعل لامحالة أنها حماية لطفل المستقبل وأم الغد ، فبالإضافة إلى تجريمه للإجهاض حماية للجنين أحاط هذا الأخير حماية أكثر من خلال تجريم فعل إهمال الزوجة الحامل نظرا لخطورة هذا الفعل على صحة الجنين من جهة ونفسية الأم من جهة ثانية. |
