| المستخلص: | The competent authorities of interpretation the constitution are numerous, it could be political, or judicial. And Our research focuses on the competence of the constitutional judiciary to interpret the Constitution, which is one of the most important functions carried out by the constitutional judge, that the nature of the judge's work requires him to interpret the constitution before implementing his judgment and maintaining the supremacy of the constitution as the supreme law of the State. In recognition of this important role of constitutional judiciary, many states have tended to include their constitutions explicit texts relating to this jurisdiction, while others have failed to explicitly mention this in their constitutions. The competence of the constitutional judiciary to interpret the constitutional texts has many important results. The need to interpret these texts is due to various reasons and this interpretation is done by using a set of internal and external means of interpretation. And in front of this important role played by the constitutional judiciary, which may lead to constitutional amendments by the competent authority for the amendment, we have highlighted this jurisdiction in a group of countries, that are the United States of America, Egypt, Syria and Iraq. إن الجهات المختصة بتفسير الدستور عديدة، قد تكون سياسية أو قضائية، وإن بحثنا هذا يركز على اختصاص القضاء الدستوري بتفسير الدستور، حيث يعد من أهم الاختصاصات التي يقوم بها القاضي الدستوري، ذلك أن طبيعة عمل القاضي تفرض عليه تفسير النص قبل إعمال حكمه، والحفاظ على سمو الدستور باعتباره القانون الأعلى في الدولة، واعترافا بهذا الدور الهام للقضاء الدستوري، اتجهت العديد من الدول إلى تضمين دساتيرها نصوصا صريحة تتعلق بهذا الاختصاص، في حين غفلت دولا أخرى عن الإشارة إلى ذلك بشكل صريح في دساتيرها. ويترتب على اختصاص القضاء الدستوري بتفسير النصوص الدستورية العديد من النتائج الهامة، وإن الحاجة إلى تفسير هذه النصوص يرجع إلى أسباب متعددة، ويتم هذا التفسير باستخدام مجموعة من وسائل التفسير الداخلية والخارجية. وأمام هذا الدور الهام الذي يقوم به القضاء الدستوري والذي قد يقود إلى تعديلات دستورية تقوم بها السلطة المختصة بالتعديل، فقد سلطنا الضوء على هذا الاختصاص لدى مجموعة دول هي الولايات المتحدة الأمريكية ومصر وسوريا والعراق. |
