| 520 | |a لقد أثار انتشاء جائحة فيروس كورونا المستجد العديد من الإشكاليات القانونية بشأن تنفيذ العقود. ومن أهم هذه الإشكاليات التساؤل عن مدى كفاية القواعد القانونية في القانون المدني المصري لمواجهة الأثار القانونية التي صاحبت ظهور هذه الجائحة؟ وقد انقسم الفقه للإجابة عن هذا التساؤل على رأيين: يرى الأول منهما أن جائحة فيروس كورونا المستجد تعتبر قوة قاهرة. وفي المقابل يرى جانب آخر من الفقه أنها لا تعدو أن تكون ظرفا طارئا. وقد حاولت هذه الدراسة أن تبين مدى قصور هاتين النظريتين بتنظيمهما الحالي في التشريع المصري في مواجهة آثار هذه الجائحة على تنفيذ العقود التي كانت مازالت سارية وقت ظهورها. واتجهت هذه الدراسة صوب التشريعات المقارنة لتقدم إلى المشرع المصري صورة جديدة من صور التنظيم القانوني لنظريتي القوة القاهرة والظروف الطارئة في التشريعين الأمريكي والفرنسي تعتبر من وجهة نظرنا -أكثر حداثة وقدرة على مواجهة الظروف الاستثنائية بصفة عامة وجائحة فيروس كورونا المستجد بصفة خاصة في ضوء المنهج التحليلي المقارن. ولتحقيق ذلك جاءت الدراسة في فصلين يسبقهما مبحث تمهيدي بعنوان ماهية مبدأ التوقع المشروع للمتعاقدين. وقد ناقشنا في الفصل الأول مظاهر حماية التوقعات المشروعة للمتعاقدين بين الإبقاء على العقد أو إنهائه باعتبار جائحة كورونا قوة قاهرة في التشريعين المصري والأمريكي. وخصصنا الفصل الثاني لدراسة مدى حماية التوقعات المشروعة للمتعاقدين بين تدخل القاضي أو إعادة التفاوض باعتبار جائحة كورونا ظرفا طارئا في التشريعين المصري والفرنسي. |b Legal means to protect contractors' legitimate expectations in light of the coronavirus pandemic, Comparative Study The spread of the coronavirus pandemic has raised many legal problems over contract execution. One of the most important problems is the question of the adequacy of the legal rules in Egypt's civil law to cope with the legal effects that accompanied the emergence of this pandemic. The jurisprudence to answer this question was divided by two opinions: The coronavirus pandemic is considered a force majeure. In contrast, another aspect of the doctrine finds that it is nothing but an emergency circumstance. The study attempted to demonstrate the extent to which these two theories, in their current regulation, fell short of Egyptian legislation in the face of the effects of the pandemic on the implementation of contracts that were still in force at the time of their emergence. This study was geared towards comparative legislation to present the Egyptian legislature with a new picture of the legal regulation of the theory of force majeure and conditions in American and French legislation, which, in our view, is more modern and capable of coping with exceptional circumstances in general and the coronavirus pandemic in particular in light of the comparative analytical approach. To this end, the study is presented in two chapters preceded by a preliminary examination entitled "What is the principle of legitimate expectation of contractors". In chapter I, we discussed the protection of contractors' legitimate expectations between maintaining or terminating the contract as a force majeure in Egyptian and American legislation. We devoted chapter II to examining the extent to which contractors' legitimate expectations are protected between the intervention of the judge or the renegotiation of the coronavirus pandemic as an emergency circumstance in Egyptian and French legislation. | ||
