| المستخلص: | تمتع السفن بالجنسية يحدد موقعها بأعالي البحار حيث لا توجد سيادة وطنية بما يضمن مصالحها مما يحتم توفر رابطة وطنية حقيقية بين السفينة والدولة، كما تحدد الاختصاص القضائي في حالة تنازع القوانين، ولأهميتها فكل دولة تضع شروطا خاصة على أساسها تمنح جنسيتها للسفينة. ولقد عالج المشرع البحريني في القانون البحري الجديد رقم 10 لسنة 2022 مسائل كثيرة منها ما يتعلق بمفهوم السفينة حيث تبنى تعريف اشمل من التعريق الذي كان معمول به في القانون السابق، وكذلك توسع في منح الجنسية البحرينية للسفينة -موضوع البحث- بشكل جذري بحيث قرر منح الجنسية للسفينة بمجرد تسجيلها والتخلي عن شرط الملكية الوطنية، والسماح لمواطني دول مجلس التعاون بتملك السفن دون شروط، وكذلك السماح للشركات المسجلة في مملكة البحرين دون النظر لجنسية مؤسسيها، تماشيا مع نظرية التوسع والانفتاح الاقتصادي لمملكة البحرين. The enjoyment of nationality by ships is determined by their location on the high seas, where there is no national sovereignty to guarantee their interests, which necessitates a real national bond between the ship and the State and determines jurisdiction in the event of conflict of laws, and because of its importance, each State sets special conditions on the basis of which it grants its nationality to the ship. The Bahraini legislator has addressed in the new Maritime Law No. 10 of 2022 many issues, including those related to the concept of ship, where he adopted a more comprehensive definition than the definition that was in force in the previous law, As well as expanding the granting of Bahraini nationality to the ship- the subject of research- radically so that it decided to grant citizenship to the ship as soon as it is registered and abandon the requirement of national ownership, and allow citizens of the Gulf Cooperation Council countries to own ships without conditions, as well as allowing companies registered in the Kingdom of Bahrain without regard to the nationality of its founders, in line with the theory of expansion and economic openness of the Kingdom of Bahrain. |
