| المستخلص: | يعنى هذا البحث بتطبيقات العرف في باب المعاملات من خلال الأحاديث النبوية الواردة فيه، فأهمية الموضوع تنبع من حيث تعلقه بأحاديث رسول الله صلى الله عليه وسلم التي أقرت العرف في مسائل المعاملات، ويهدف إلى بيان درجة الأحاديث من حيث الصحة أو الضعف، من خلال دراسة أسانيدها، والوقوف على تطبيقات العرف في باب المعاملات، وسلكت المنهج الاستقرائي التحليلي، وقسمته إلى تعريف بالعرف، وأقسامه، وحجيته، وتطبيقات العرف في السنة النبوية باب المعاملات"، وخلصت الدراسة إلى عدة نتائج أهمها: حجية العرف، الوقوف على درجة الأحاديث التي أقرت العرف في بابه، ما أقره النبي صلى الله عليه وسلم في عهده من الأعراف التي كان عليها الناس يعتبر من السنة التقريرية. This research is concerned with the applications of custom in the chapter on transactions through the hadiths contained therein. The importance of the topic rises from its relation to the hadiths of the Messenger of God, (PBUH), which approved custom in transactional issues. It aims to indicate the degree of hadiths in terms of validity or weakness, by studying its chain of narrators and examining the applications of custom in the field of transactions. In the applications of custom in the chapter on transactions, the inductive-analytical approach was followed and divided into a definition of custom, its divisions, and its authority, and the applications of custom in the Prophetic Sunnah, the chapter on transactions. The study concluded with several results, the most important of which are: Authentic custom, based on the degree of hadiths that approved custom in its chapter. The Prophet, (PBUH), approved it in his era from the customs that people were upon, and it is considered a declarative Sunnah. |
