| 520 | |b The present issue dealt with arises in terms of access to judge, and will be mainly devoted to the study of evolution of the notion of attribution jurisdiction in labour litigation. Does the organic criterion enforced in Algerian Law make it possible to settle questions of competence in the field of labour litigation? It is clear that the question of attribution jurisdiction in social matters is problematic, particularly in terms of complexity, because social security litigation is split between several competent courts and appeals boards. It is evident to us that the organic criterion advocated by the legislator is increasingly deficient in order to regulate questions of ratione materiae division of powers in a general way and with regard to social litigation more particularly and that new solutions are proposed and subject to reflection and debate. | ||
| 520 | |d La problématique traitée se pose en termes d’accès au juge, et sera principalement consacrée à l’étude de l’évolution de la question de la competence d’attribution en matière de contentieux social. Le critère organique en vigueur en droit Algérien permet-il de régler les questions de compétences en matière de contentieux social? Il ressort clairement que la question de la compétence d’attribution en matière sociale pose problème notamment en termes de complexité et ce du fait que le contentieux de la sécurité sociale est éclaté entre plusieurs juridictions et commissions de recours compétentes également. Il est à notre sens évident que le critère préconisé par le législateur est de plus en plus déficient pour régler les questions de répartitions des compétences rationae materiae d’une manière générale et pour ce qui concerne le contentieux social plus particulièrement et que dès lors de nouvelles solutions sont proposes et soumises à la réflexion et au débat. | ||
